Over the last few weeks, multiple courts have issued decisions on COVID-19 vaccine mandates. At the same time, the CDC stopped using the term “fully vaccinated” and significantly altered guidance on quarantine and isolation for those exposed to and testing positive for COVID19. On Friday evening November 12, 2021, the Fifth Circuit Court of Appeals reaffirmed the stay prohibiting the implementation of the OSHA Emergency Temporary Standard (ETS) which would require private employers with 100 or more employees to mandate that their employees either get vaccinated against COVID-19 or submit to weekly testing for the virus.
