We assist clients in the preparation of requests for equitable adjustments and claims on public work projects. Concerning claims submitted by our clients on federal or federally assisted construction contracts, we make certain that the claims do not run afoul of the Federal False Claims Act. We view the avoidance of disputes as our first priority and we work closely with our clients to resolve disputes in the first instance. If a dispute cannot be resolved, we vigorously represent our clients with claims at the federal, state and local level, and at all stages of the claims process. We have litigated many claims before various agency boards and have handled appeals before the United States Court of Appeals, Federal Circuit.

Our Construction Group regularly advises clients on regulatory compliance with respect to public contract work. We have counseled clients on compliance with prevailing wage acts, such as Davis Bacon Act and State Prevailing Wage Acts. We have advised federal contractor clients on their affirmative action obligations as enforced by the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP). We have counseled our clients through the nuances of OFCCP audits and negotiated conciliation agreements with the OFCCP. We also counsel clients on OSHA compliance, including, the client’s rights during an OSHA inspection and the right to contest an OSHA citation.
