Pamela M. Tobin has over twenty-five years of experience litigating complex commercial cases in State and Federal court. Pamela takes pride in mastering the facts and law early in her cases to position them to obtain the most favorable outcome for the client in the most expeditious timeframe possible. When the facts warrant, she will file motions seeking immediate injunctive relief and/or negotiate tenaciously for outcomes that secure prompt relief. Pamela also moves cases to trial, including pushing for all relevant electronic information. She has managed to secure decisions reimbursing her clients’ counsel fees and costs as a result of the Court’s finding that the opposing parties had engaged in vexatious litigation.

Pamela began her career as an associate at Dechert, LLC. Seeking hands-on litigation experience, she chose to work next at two mid-sized Philadelphia firms (LaBrum & Doak which ultimately closed and thereafter, Fox Rothschild) where she handled complex high stakes commercial cases, which included representing:

  • A demolition contractor to obtain a $2 million payment against a hotel owner
  • The Pennsylvania Insurance Commissioner to obtain damages for fraud
  • Accountants and attorneys sued for professional malpractice
  • A church sued for slander and libel

Pamela successfully obtained a decision upholding a limitation of liability provision in a design contract in Valhal Corp. v. Sullivan Assocs. before the United States Third Circuit Court of Appeals (44 F.3d 195).

For over ten years at Kaplin Stewart Meloff Reiter & Stein, P.C., Pamela has litigated complex commercial disputes which included representing:

  • Developers to prosecute tortious interference and antitrust claims against competing landowners
  • Owners seeking relief from easements, illegal storm water discharge, and boundary contests
  • Developers seeking waivers and variances to develop land — including a treatment center for residents with addictive disorders
  • Partners/shareholders claiming breach of fiduciary duty and/or seeking to dissolve the business
  • Software companies sued for breach of contract and negligent provision of design implementation services

Pamela successfully obtained a decision upholding landowners’ storm water rights against a national railroad company in MD Mall v. CSX Transportation Corp. before the Third Circuit (715 F.3d 479). She also obtained a decision upholding a school district’s right to fence its property before the Commonwealth Court (128 A.3d 851).

Additionally, Pamela handles litigation matters in Orphans’ Courts including prosecuting and defending undue influence claims. The daughter of teachers and a parent herself, Pamela also has represented students accused of violating school rules and has been successful in abating the school’s disciplinary measures.

Pamela frequently writes and lectures on diverse legal topics.

Life

Pamela lives with her three energetic, highly vocal, and lovely daughters in Wyncote, a northern suburb of Philadelphia. The same wooded area where she grew up, they arrived there after living on the northern California peninsula for seven years. Pamela’s eldest attends Grinnell College in Iowa. Her twins attend her alma mater, Cheltenham High School. A voracious reader, Pamela is an active member of two book clubs: one located in Cheltenham, the other in Abington. She enjoys painting water colors while traveling, and visits to the New Jersey shore with her family. Hands down, her most pleasurable time is watching her daughters either act in or direct a play or movie, dance in Color Guard, or deliver a well written and passionate essay.
